Introduction. Welcome to Hiurd, LLC ("Hiurd," "we," "our," or "us"). Your privacy is important to us. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use the Hiurd mobile application (the "App") and our website (the "Site").
Hiurd operates a secure, licensed payment system called PayVault, which holds funds in escrow while services are being performed. PayVault ensures that Service Providers are paid for completed work and that Job Creators only release funds when satisfied with the results. This Privacy Policy also describes how data related to payment activity, dispute resolution, and user verification within PayVault is handled.
By using our services, you expressly consent to the data practices described in this Privacy Policy and agree to be bound by our Terms of Service. If you do not agree with these terms, you must immediately discontinue use of all Hiurd services.

Information We Collect.
We collect the following types of information:-
Information You Provide Directly
- Legal name, address, telephone number(s), and email address
- Screen name, password, and payment method
- Business name, Social Security Number (SSN), Employer Identification Number (EIN), and driver’s license number (for service providers)
- Any additional information necessary to verify your identity and process payments

We automatically collect:- Device type, browser type, and IP address
- Browsing behavior and referring URLs
- Unique device identifiers (IMEI, UDID, MAC address, IDFA)
- Cookies and tracking data to improve our services

Identity Verification & Background Checks
By using Hiurd, you consent to identity verification (KYC) checks conducted by Authenticate, a third-party verification provider.
For Service Providers in certain categories, we may collect and process criminal background check data through Authenticate. These categories include, but are not limited to: child & elderly care (babysitting, senior assistance, special needs care), lessons Involving Minors (tutoring, sports coaching, music/dance instruction, swimming lessons, language instruction), wellness services (therapists, marriage counselors, massage therapists, physical therapists, fitness trainers). These checks help maintain a safe marketplace and ensure compliance with Hiurd’s policies. For wellness service providers who may handle protected health information (PHI), additional HIPAA compliance measures apply. Such providers must maintain compliance with HIPAA Privacy and Security Rules, including: implementing appropriate administrative, physical, and technical safeguards, maintaining PHI confidentiality and limiting disclosures, following breach notification procedures, and completing required HIPAA training.Hiurd does not store raw background check data; Authenticate processes and determines eligibility.

Location Information
If you use location-based features, we may collect and store your location data. You can disable location tracking through your device settings, but this may impact your ability to use certain features. -
To enable certain features of the Hiurd App, we may request access to your device’s camera, photo library, microphone, and location. For example, you may choose to upload job photos or videos, verify your identity, or use voice communication features. You can manage these permissions in your device settings. Disabling them may limit functionality within the App.

Third Party Providers
We may share necessary information with third-party service providers, including payment processors (e.g., Stripe) and identity verification partners (e.g., Authenticate). These third parties operate independently, and Hiurd is not responsible for their privacy policies, data handling, security breaches, or service availability.
Users expressly acknowledge and agree that they provide data to these third parties at their own risk and are solely responsible for reviewing and accepting their respective privacy policies and terms of service of such third parties. Hiurd assumes no responsibility or liability for any actions, omissions, or data handling practices of these third-party providers.

Arbitration Agreement. By using Hiurd, you agree that any disputes or claims arising from this Privacy Policy or your use of the Hiurd platform shall be resolved exclusively through binding arbitration in Utah, in accordance with the American Arbitration Association (AAA) rules.
Users expressly and irrevocably waive their right to participate in class-action lawsuits, mass arbitrations, representative actions, or any other collective legal action against Hiurd, to the fullest extent permitted by law. Arbitration shall be conducted on an individual basis only, and class-wide claims or coordinated mass filings are prohibited.
If multiple individual arbitration claims are filed in a manner that is functionally equivalent to a class-action filing, Hiurd reserves the right to consolidate cases or seek dismissal.

Indemnification. You agree to indemnify, defend, and hold harmless Hiurd, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or legal expenses (including reasonable attorneys' fees) arising from: (i) your use of the platform; (ii)~~,~~ violation of this Privacy Policy; (iii) any harm caused by your actions; (iv) any data breaches or privacy violations caused by your negligence or unauthorized sharing of credentials; (v) any misuse of the platform's security features; or (vi) any claims related to your content or personal information you provide to the platform.

Data Retention Policy. We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, enforce our agreements, and maintain platform integrity. Upon receiving a verified user request to delete their account, Hiurd will delete or anonymize personally identifiable information where feasible. However, certain categories of data may be retained for a limited period as permitted or required by law, including: Identity verification status and account history, financial and transaction records (e.g., job payments, escrow activity, disputes), records relevant to fraud prevention, abuse investigations, or law enforcement inquiries, Audit logs, messaging metadata, and platform usage activity (non-content data)
These retained records support compliance with applicable tax, financial, anti-fraud, and regulatory obligations, and may be disclosed to legal authorities when appropriate. All data no longer needed will be securely deleted or irreversibly anonymized using industry-standard data protection methods.

Security Measures. We use industry-standard security practices to protect your personal information, including encryption, secure storage, and regular security audits. However, no online platform is 100% secure, and Hiurd expressly disclaims any warranties or guarantees regarding the security of your data. We are not liable for any unauthorized access,data breaches, system failures, cyber attacks, or other security incidents, whether caused by third parties, force majeure events, or technical malfunctions beyond our reasonable control. Users acknowledge that they transmit and store data on our platform at their own risk.
To maintain security, Hiurd reserves the right to temporarily restrict or suspend user access in cases of suspected unauthorized activity, fraud, cybersecurity threats, or system maintenance. Users acknowledge that Hiurd shall not be liable for losses, inconvenience, or damages caused by such security-related access restrictions.

Governing Law. This Privacy Policy shall be governed by and construed under the laws of the State of Utah, without regard to its conflict of law principles. Users agree that any legal action or proceeding related to this Privacy Policy, Hiurd’s services, or data handling must be filed and conducted exclusively in the state or federal courts located in Utah.
Users waive any objections to jurisdiction or venue in Utah courts and agree that Utah courts shall have exclusive jurisdiction over all disputes arising from this Privacy Policy.

Your Rights & Choices
You have the right to:- Access & update your information through your Hiurd account.
- Opt-out of marketing communications by adjusting your account preferences
- Request deletion of your account and data by contacting support
- Control cookies and tracking via your browser settings
Depending on your location, you may also have additional rights under data privacy laws such as the California Consumer Privacy Act (CCPA) or the General Data Protection Regulation (GDPR). Hiurd will honor such rights in accordance with applicable law.

Children’s Privacy. Hiurd is not intended for individuals under the age of 18. We do not knowingly collect personal data from users under 18 years old. If we learn that a person under 18 has created an account or provided personal information without proper authorization, we will delete the information promptly and terminate the account.

Third-Party Links & Social Media. Our App and Site may contain links to third-party websites or social media features. These third parties have their own privacy policies, and we are not responsible for their practices.

Payment Processing & Financial Transactions. Hiurd operates as a licensed escrow agency in the state of Utah under NMLS #2619771. This license and our services are subject to applicable state and federal regulations, including but not limited to the Utah Money Transmitter Act, Bank Secrecy Act (BSA), and anti-money laundering (AML) regulations. As part of our regulatory compliance obligations, Hiurd:
- Reports suspicious activities to relevant authorities
- Monitors transactions for potential money laundering
- Maintains comprehensive transaction records
- Conducts regular AML compliance audits
- Files required regulatory reports
- Cooperates with law enforcement investigations
As part of our services, Hiurd facilitates payment transactions between Job Creators and Service Providers through our branded escrow system, PayVault. Funds held in PayVault remain secure until the completion of services, at which point they are disbursed according to the terms outlined in our platform agreements. Hiurd does not directly transmit or store user funds. All transactions are processed through Stripe, Inc., a licensed money transmitter and third-party payment provider. Stripe’s infrastructure and licensing enable payment processing in all 50 U.S. states. Hiurd users agree to Stripe’s Terms of Service and Privacy Policy as a condition of using the platform. Users acknowledge that transactions may be delayed, frozen, or rejected based on suspicious activity monitoring or regulatory compliance requirements.
- Updates to This Privacy Policy. We may update this Privacy Policy from time to time. We will notify users of significant changes by posting an updated version on our website and App at least 30 days before the changes take effect, and by sending an email notification to the email address associated with your account and push notifications if allowed. Your continued use of Hiurd after such changes constitutes acceptance of the updated Privacy Policy.
